Welcome to ConditionIt. By accessing, registering, or using the ConditionIt website, mobile application, and associated services, you agree to be bound by these terms.

1. Nature of ConditionIt Services

ConditionIt provides AI-powered services that facilitate property managers, landlords, and inspectors in creating property condition reports. We also provide secure portals for tenants to review and sign these reports in cooperation with property owners.

2. Contractual Relationships

By using ConditionIt, a property owner enters into a contractual relationship with us governed by these Terms. ConditionIt is not a party to, nor bound by, the terms of any lease or contractual relationship between a property owner and a tenant. We do not act as an agent or authorized representative in relation to the management of any tenancy or property dispute.

3. Accounts and Security

In order to use ConditionIt as a property manager or owner, you must register for an account using true and correct information. You are solely responsible for maintaining the confidentiality of your login details. You must notify us immediately if you suspect any unauthorized access. We reserve the right to suspend or terminate accounts that breach these Terms or provide false information.

4. Legal Compliance

While ConditionIt endeavors to build tools that assist with compliance regarding condition reports, the ultimate responsibility for legal compliance remains with the property owner and tenant. Information generated by our AI or provided on our website should not be regarded as a substitute for professional legal or real estate advice.

5. Intellectual Property Rights

ConditionIt owns all rights to the platform, website content, software, and AI models ("Our IP"). You are permitted to use Our IP only as expressly authorized. This excludes the raw video, audio, and photo content you upload during inspections, which you retain ownership of. By uploading your content, you grant ConditionIt a license to process and display it solely to provide the reporting service to you.

6. Limitation of Liability

To the maximum extent permitted by law, ConditionIt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. We are under no obligation to become involved in any dispute between users (e.g., between a landlord and a tenant).

7. Modification of Terms

ConditionIt may, in its sole discretion, modify these Terms at any time. We will endeavor to notify you of significant changes, but you agree to periodically review the most up-to-date version. Continued use of the platform constitutes agreement to the modified Terms.
